	answer text	<p>A licence is required for the export of cyber security software if that item is specially designed for military use or has a cryptographic capability as specified in Council Regulation (EC) No 428/2009 (which is known as the 'EU Dual-Use Regulation').</p><p>All export licence applications are assessed on a case-by-case basis against the Consolidated EU and National Arms Export Licensing Criteria taking into account all relevant factors, including the prevailing circumstances in the recipient country and the stated end-use. A licence would not be issued if to do so was inconsistent with any of the Criteria.</p>
