Data onappeals includes ESA claims up to the end of May 2012 (the latest monthwhere we have sufficient volumes of appeals heard to include in thepublication) where the person claiming has been assessed to be fit forwork, they subsequently appeal the Department's decision and the appealhas been heard by TribunalsService.<br />3. Due to thetime it takes for appeals to be submitted to the Tribunals Service andheard, it is likely that there are more appeals that have not yet beenheard. Therefore these figures should be treated as emerging findingsrather than final at thisstage.<br />4. The figure of54% decisions in favour of the appellant is comparable to the figureprovided in the previous PQ of 56%. The total appellant success rate atJuly 2013 is 37% so Brighton and Hove LA is above that figure.
