<p>I have been asked to reply on behalf of the Department of Energy and Climate Change.</p><p>In the case of installations, covered by the Industrial Emissions Directive and waste and mining waste operations, financial competence checks are made at the permitting stage and the Environment Agency will only issue a permit if it believes the operator is capable of meeting the obligations of the permit. Financial competence is considered at the compliance assessment stage for installations, waste operations, mining waste operations; as well as for water discharge and groundwater activities. Financial guarantees are also required for certain types of facilities, such as a hazardous waste facility, under the Mining Waste Directive.</p> |
