§ Lord WhittyThe Environment Agency has an enforcement and prosecutions policy that sets out the general principles which the agency follows to ensure that preventive or remedial action is taken to protect the environment or to secure compliance with the regulatory system governing waste.
Local authority prosecutions are a matter for individual local authorities to decide upon. Defra has funded the agency to develop the local authority capacity programme to develop and improve local authority enforcement skills.
