§ Mr. GerrardTo ask the Parliamentary Secretary, Department for Constitutional Affairs how many statutory reviews under section 101 of the Nationality, Immigration and Asylum Act 2002 have resulted in the High Court issuing a certificate of no merit under section 101(3)(d) in each month since April 2003. [175823]
§ Mr. LammyThe Administrative Court Office does not keep a record of the number of cases in which a certificate of no merit is issued. To ascertain this information each court file would have to be individually inspected to check the decision of the judge. These figures could not be obtained without incurring disproportionate costs.
However, I am able to offer information from the Legal Services Commission (LSC). They have received 5 certificates of no merit for statutory review from the Administrative Court under section 101(3)(d) since April 2003.
