HC Deb 23 March 2004 vol 419 c766W
Mr. Hoban

To ask the Deputy Prime Minister if he will make a statement on the basis of valuations to be used for compulsory purchase orders when the land to be acquired is designated for road building. [162986]

Keith Hill

Irrespective of the purpose for which land is being acquired under compulsory purchase powers, its value has to be assessed in accordance with the compensation code set out in Part 2 of the Land Compensation Act 1961 and supplemented by case law. Where the acquiring authority and the vendor are unable to agree the amount payable on that basis, the matter falls to be settled by the Lands Tribunal in accordance with the provisions of Part 1 of the same Act.
