To ask the Secretary of State for Transport pursuant to his answer of 10 March 2004,Official Report, column 1488W, on rail compensation, if he will list (a) the compensation arrangements for delays and cancellations, of each train operation company's Passenger Charter and (b) the date when each of the franchises is due for renewal. Passenger's Charters are available from individual train operating companies. The terms and conditions are based on the National Rail Conditions of Carriage. As a minimum, passengers travelling without a season ticket will be entitled to compensation to the value of 20 per cent. of the fare paid for the effective leg where the journey is delayed by more than an hour because of an operator's failure or infrastructure difficulties. Season ticket holders are compensated if performance over the period preceding renewal falls below the published standards.
