To ask the Secretary of State for Trade and Industry what discussions she has had with representatives of the European Commission about the possibility of investigations into the implications for state aid of provisions contained in the Energy Bill. [178667]

The main state aid implication in the Energy Bill arises from the creation of the Nuclear Decommissioning Agency (NDA). DTI officials have had a number of informal meetings with the Commission services on this case.

As a result of these meetings a formal notification of the UK's intention to support the creation of the NDA was submitted to the European Commission in December 2003. The Commission are still considering this case.
