Lord Lester of Herne Hill

asked Her Majesty's Government:

Whether they have requested or intend to request the United States Government to extradite British citizens detained in Guantanamo Bay to face trial in this country for terrorist or other serious criminal offences; and, if not, why not. [HL3920]

Baroness Symons of Vernham Dean

It is not the practice or policy of the Government to comment on whether an extradition request may be made in any individual case. Exemption 4A of the Code of Practice on Access to Government Information applies.

We have been engaged in regular discussions with the US authorities about the British detainees at Guantanamo Bay. We are not prepared to go into the details of these discussions.

It is not our practice to comment on evidence against any individual, which may or may not be used in criminal proceedings (Exemption 4A of the Code of Practice on Access to Government Information applies). Any evidence received would be passed to the prosecuting authorities as appropriate.
