To ask the Secretary of State for Health what steps he is taking to enforce compliance by individual health trusts in supplying information required under the Data Protection Act 1998. [92186]

[holding answer 21 January 2003]: The responsibility for compliance with the Data Protection Act rests with individual national health service trusts. Enforcement is undertaken by the Information Commissioner.

The Department supports the NHS in meeting data protection requirements through the provision of guidance and through performance management arrangements.
