To ask the Secretary of State for Education and Skills what action he will take to ensure that Special Educational Needs and Disability Tribunal decisions in favour of parents are fully implemented by local education authorities. [140704]

The Education (Special Educational Needs) (England) (Consolidation) Regulations 2001 set out the actions that an authority must take to comply with a Tribunal order. If the authority does not comply within the appropriate period, the parent may complain to my right hon. Friend the Secretary of State for Education and Skills. It will then be open to him to issue a direction under sections 496 or 497 of the Education Act 1996. Section 496 applies if the local education authority has acted unreasonably with respect to the exercise of any power or duty. Section 497 applies if the authority has failed to discharge a duty imposed on them.
