§ Mr. MilibandSchools must have capability procedures for dealing with teachers whose performance is unsatisfactory and fails to improve. Capability procedures are drawn up locally by schools and LEAs. The Secretary of State issues guidance on teacher capability to ensure that these matters are handled effectively and fairly, and will be consulting on new guidance shortly.
