What methodology was used to establish the differentials in tariffs payable to the Educational Recording Agency Limited in primary school, secondary school, and further and higher education students. [HL2304]

The Government play no part in determining the tariffs payable to the Educational Recording Agency. The Secretary of State can only consider matters of clarity when certifying by statutory instrument new tariffs established by the Educational Recording Agency. The independent Copyright Tribunal can, however, he asked by educational establishments to determine whether any of the tariffs are reasonable in the circumstances.
