To ask the Secretary of State for Foreign and Commonwealth Affairs if he will make a statement on the constitutional position of(a) the Falkland Islands and (b) Gibraltar. [58955]

The constitutional position of the Falkland Islands is expressed in the preamble to Chapter 1 of the 1985 Falkland Islands Constitution Order. In the case of Gibraltar this is expressed in the preamble to the 1969 Gibraltar Constitution Order. The constitutional positions of Gibraltar and the Falkland Islands are bound by the legal frameworks in which they are set, and in this respect they are quite distinct.
