The Department of Health has fully considered the judgments of the European Court of Justice in the cases ofKohll and Decker and concluded that they have no direct effect on National Health Service patients. These judgments were given in the context of Luxembourg national health insurance law, in circumstances which are not replicated in NHS law within the United Kingdom.
