To ask the Secretary of State for the Home Department what higher court judicial decisions have been made as to the admissibility of hearsay evidence in proceedings seeking Antisocial Behaviour Orders; and if he will make a statement. [12027]

In R. (on the application of McCann and Others)v. Manchester Crown court, the Court of Appeal held that applications for Antisocial Behaviour Orders are made in civil proceedings, and that therefore the civil standard of proof applied (although that standard is a flexible one) and hearsay evidence was admissible.
