To ask the Secretary of State for Wales what discussions he has had with National Assembly Secretaries on the ruling of Lord Justice Tuckey on legislative provision on planning matters in Wales in relation to the requirements of European legislation and of the Human Rights Act 1998. [148320]

I have regular discussions with Assembly Secretaries about a range of issues, including both planning law and the impact of the Human Rights Act 1998 in Wales.

The judgment of the Divisional Court is now the subject of an appeal. The appeal will be heard in the House of Lords on 26 February. The National Assembly is being kept abreast of developments.
