asked Her Majesty's Government:

Whether they will publish the documents relating to the history of the discussions leading up to the enactment of the Merchant Shipping Act 1988 and the making of regulations under it, given that the documents were disclosed for the purpose of the Factortame litigation in relation to the issue of liability for breaches of Community law and were referred to in the English courts' decisions. Consideration of the noble Lord's request has raised a number of complex legal issues which we regret have taken a considerable amount of time to resolve. As soon as we have done so we will write to him and place a copy of the letter in the Libraries of the House.
