HC Deb 06 February 2001 vol 362 c463W
Mr. Key

To ask the Secretary of State for Defence if he will list the disciplinary offences falling to summary discipline procedures for each of the armed services and the punishments which may be imposed. [148201]

Mr. Spellar

[holding answer 5 February 2001]: A list of disciplinary offences falling to summary discipline procedures and the punishments available will be placed in the Library of the House.

An offence should be tried by court martial if it is likely to merit punishment in excess of a Commanding Officer's powers of punishment, when imprisonment might be awarded, or if there are legal complexities, or where the accused elects trial by court martial.
