asked Her Majesty's Government:

Further to the Written Answer by Lord Bassam of Brighton on 24 January (WA 175), whether they consider that, where a contracting state confers the right to a certain sort of trial, that right must be enjoyed without direct or indirect discrimination on grounds of race or ethnic origin by virtue of Article 6 of the European Convention on Human Rights read with Article 14. The Government believe that rights under Article 14 attach to the right to a fair trial and not to a certain sort of trial. This does not affect the Government's determination to ensure that criminal justice legislation does not discriminate on the grounds of race or ethnic origin.
