Further to the Written Answer by Lord Hunt of Kings Heath on 20 March (WA 12), which agencies in England, Scotland, Wales and Northern Ireland are responsible for the enforcement of the smoking prohibition where food is prepared for public consumption; and how many prosecutions have been brought in the last five years in each of the four areas. Local authorities are responsible for enforcing food hygiene legislation prohibiting from smoking persons working in food preparation areas of food businesses. Information on the number of prosecutions in this respect is not held centrally. However, prosecution is not usually the initial response to contraventions of food hygiene legislation.
