asked Her Majesty's Government:

What estimates they have made of the annual cost of enforcing the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999 (S.I. 1999/2170) which came into force on 1 September; who is to be responsible for enforcing the regulations; and what provision they have made for payment of the cost of enforcement. The decision on who will enforce the regulation lies entirely with the Secretary of State. It is the intention that enforcement of the regulation will primarily be carried out by the police. This is in line with other legislation concerning the protection of birds.

The vast majority of police forces in England already have a wildlife liaison officer (PWLO) who is responsible for enforcement of wildlife legislation. The Government consider that enforcement of the legislation is not likely to add significantly to the workload of the PWLOs; therefore no additional staff costs for enforcement purposes are deemed necessary.

In 1992 the Government set up the UK Lead Shot in Wetlands Working Group, consisting of representatives from shooting, farming and conservation organisations, along with the gun and ammunition industry, to consider a mechanism to achieve a phase-out of the use of lead shot over wetlands. Full and regular consultation with all interested parties has taken place since that date. This working group recommended a two-year voluntary phase-out of lead shot over wetlands which began in 1995.

In 1997, the Government carried out a consultation exercise with more than 60 interested organisations to establish whether to continue with the voluntary approach or take other measures. Responses to the consultation exercise were carefully analysed and revealed a majority of support for a move to a statutory ban as soon as possible.

After detailed consideration a consultation document was issued on 8 April outlining draft regulations to restrict the use of lead shot. The time period for this consultation was greater than the minimum outlined in the Environment Protection Act 1990. The consultation period ended on 14 May. However responses were received and accepted until the beginning of June.

The consultation documents were sent to over 5,000 owners and occupiers of sites of special scientific interest affected by the draft regulation along with the organisations listed in the table below.
