§ Ms JowellThe consultation confirmed that as the Code is non-statutory it cannot be used as the basis of a legal decision. It may, in time, though, help inform the thinking of Employment Tribunals on what constitutes "reasonable behaviour". That will, however, be a matter for the Tribunals themselves.
