§ Mr. BattleArticle 60 (2) [ex Article 73g (2)] of the EC Treaty is not a power to implement sanctions but an exception to the rule that all restrictions on movement of capital and on payments between member states and member states and third countries (Article 56) should be prohibited: Article 60 (2) permits such measures in certain circumstances. There is limited power to implement unilateral sanctions under domestic legislation. There is an application for Judicial Review relating to the scope and meaning of Article 60 pending before the High Court. We are considering its position with regard to that application.
