To ask the Secretary of State for Scotland which elements of the recommendations contained in Chapter 6 of the report by the Royal Commission on Long Term Care would require(a) secondary legislation and (b) guidance to be issued for full implementation in Scotland. [75946]

Mr. Galbraith

[holding answer 11 March 1999]: Requiring property value to be disregarded for up to 3 months and raising the upper capital limit in the means test would both require secondary legislation. On the basis of the current charging arrangements, providing nursing care or all personal care free would require primary legislation. Guidance would be issued to local authorities on all such primary and secondary legislation.

From 1 July 1999, these matters will be for the Scottish Parliament.
