HC Deb 12 July 1999 vol 335 cc73-4W
Lorna Fitzsimons

To ask the Secretary of State for the Home Department what measures are taken to ensure that risk assessments in the Prison Service conform to a uniform approach. [90116]

Mr. George Howarth

The Prison Service undertakes risk assessments for a variety of purposes. These need to be based on consistent principles, but responsive to the complexities of individual situations. Arrangements are supported by detailed guidance, defined procedures and standards audit. Prisoners dissatisfied with decisions can make use of the request and complaints procedures.

Lorna Fitzsimons

To ask the Secretary of State for the Home Department what arrangements are in place to ensure parity of treatment in respect of entitlement to home leave across the Prison Service. [90113]

Mr. George Howarth

There is no entitlement to resettlement licence, which replaced home leave in 1995. The criteria for eligibility for resettlement licence is set out in Prison Service Instruction 36/1995, a copy of which is in the Library. The Instruction is mandatory which ensures consistency of treatment in respect of eligibility for resettlement licence.

Lorna Fitzsimons

To ask the Secretary of State for the Home Department what arrangements are in place to monitor the consistency of approach in the use by governors in the Prison Service of their discretionary powers. [90115]

Mr. George Howarth

Eligibility for temporary release does not pre-suppose it will be granted by the governor. Applications from eligible prisoners are considered on a case by case basis and subject to a risk assessment. Governors use their discretion in the light of the risk assessment and reasonableness under the Wednesbury Principle. These decisions are subject to judicial review.
