asked Her Majesty's Government:

Whether they intend to accept the opinion contained in the report of the European Commission of Human Rights of 20 October 1998 in McGonnel v. United Kingdom, that the United Kingdom is in breach of Article 6 of the European Convention on Human Rights because the Bailiff of the Royal Court of Guernsey, being both a senior member of the judiciary and a senior member of the legislature and the executive, did not satisfy the requirements of independence and impartiality. The Commission has referred this matter to the European Court of Human Rights and it will be examined by the Court in due course.
