To ask the Secretary of State for Foreign and Commonwealth Affairs what representations have been made to Spain about the incident on 29 November when a Gibraltarian was prevented entry into Spain on the basis that as a British passport holder he could not drive a Gibraltar-registered car; what undertakings have been received from Spain that similar actions will not occur again; and if he will make a statement. We are aware of the incident at the border on 29 November and understand that a report was made to the Royal Gibraltar Police. We understand that the individual concerned was able to cross the border into Spain.

We regularly make clear to the Spanish authorities their obligations to operate the border in a way consistent with their EC obligations on free movement of persons.
