To ask the Minister of State, Lord Chancellor's Department if he will consult on allowing magistrates to impose a wider range of sentences on people convicted of driving without insurance. [80472]

I have been asked to reply.

Driving without insurance is a summary only offence which currently attracts a maximum penalty of a Level 5 (£5,000) fine and an automatic endorsement of the offender's driving licence of between 6 and 8 points. The court may also disqualify the offender from driving.

The Government are aware of concern about both the maximum penalty available and the sentences which are imposed in practice. The Home Office has therefore sought the views of the Magistrates' Association on this issue. The Association's response is currently under consideration.
