To ask the Secretary of State for the Home Department what plans he has to ensure that anti-social behaviour orders are not used improperly. [41211]

The fact that only local authorities and the police, in consultation with one another, will be able to apply to the courts for orders will help to avoid any risk of improper use. It will be up to the courts to decide whether an anti-social behaviour order can be granted. We are producing detailed guidance to make clear the kind of circumstances in which applications should or should not be made.

We have already given an undertaking to Parliament to review the effectiveness of the provisions and report our findings. This review will cover the types of behaviour for which orders are sought.
