To ask the Secretary of State for the Home Department, pursuant to his document, "UK Presidency of the EU, Half Way Mark", if he will make a statement on the application of openness to UK nationals under the Schengen Information System. [54951]

Schengen, and the Schengen Information System in particular, is currently an intergovernmental arrangement outside the structures of the European Union. The United Kingdom is not a party to, or a participant in, Schengen.

When the Treaty of Amsterdam comes into force, the Schengen arrangements will be brought within the structures of the European Union but will not apply to the United Kingdom unless we choose to take part. The arrangements for data protection and subject access in respect of the Schengen Information System, once within the European Union, have not yet been decided.

2 The data cover defendants either acquitted or convicted of the offence. Hence they cover those who were prosecuted under a more serious offence but acquitted or convicted of the offence and do not cover those prosecuted for the offence but acquitted or convicted of a lesser offence

To ask the Secretary of State for the Home Department what proportion of road deaths resulted in convictions for(a) manslaughter, (b) causing death by dangerous driving, (c) careless driving, (d) causing death by careless driving under the influence of drink or drugs and (e) no conviction, in the last year for which figures are available. There were 3,598 road deaths for England and Wales in 1996. The number of prosecutions and convictions in 1996 are shown in the table for the offences specified, and the respective proportion of all road deaths.
