Mr. Burstow

To ask the Secretary of State for Health, pursuant to his answer of 7 July 1998,Official Report, column 454, concerning section 118 of the Medicines Act, what factors led him to conclude that the need for repeal or amendment of the section should be assessed after the introduction of freedom of information legislation. The freedom of information White Paper outlines the Government's intention, where appropriate and consistent with European Union law, to repeal or amend the statutory bars to disclosure of information first identified in the 1993 Open Government White Paper (Cm 2290) and bring them into line with the harm and public interest tests. Section 118 of the Medicines Act 1968 is one of a number of pieces of legislation currently under review.
