What criteria are in force to define the level of confidence required to determine that any food product is "safe" when it reaches the consumer. [HL2653]

The Food Safety Act 1990 Section 8(2) sets out the circumstances when food fails to comply with food safety requirements. These circumstances are as follows:

  • the food has been rendered injurious to health by means of adding any article or substance to the food, using any article or substance as an ingredient in the preparation of the food, abstracting any constituent from the food, subjecting the food to any other process or treatment;
  • it is unfit for human consumption;
  • it is so contaminated (whether by extraneous matter or otherwise) that it would not be reasonable to expect it to be used for human consumption in that state.
