The Secretary of state has asked me to reply to your Question about appeal decisions where one of the grounds for refusal was the protection of garden land.I enclose details of 4 appeals which were dismissed in 1996–97 and 15 which were dismissed in 1997–98. I believe this is an exhaustive list but I cannot be certain, especially as we do not have a separate refusal issue relating to protection of garden land. The details include the issues considered to be relevant to the Inspectors decision.I am arranging for copies of the Inspector's decision letters to be sent to you. From these you will be able to see whether the Inspector agreed or disagreed with any reasons for refusal by the local authority.Details of the appeals have been made available in the Library.
