To ask the Secretary of State for the Environment, Transport and the Regions what mechanisms exist for appealing against refusal by the Environment Agency to register companies as accredited reprocessors for the purpose of issuing packaging waste recovery notes under the Producer Responsibility (Packaging Waste) Regulations 1997. [22282]

The Agencies reserve the right to refuse accreditation and to remove accreditation from any reprocessor. There is no statutory right of appeal against such decisions, but reprocessors will be given the relevant Agency's reasons in writing and will be notified of the complaints procedure if they wish to pursue any grievances. This complaints procedure does not affect any other legal remedies open to the reprocessor.
