To ask the Secretary of State for the Environment, Transport and the Regions (1) what assessment he or his Department has made of the effectiveness of Statutory Instrument 3031 (1993) in respect of the Trans-frontier Shipment of Radioactive Waste Regulations; [28228]

(2) what meetings ministers or officials of his Department have had since October 1997 to discuss the implications for the import and export of nuclear materials to and from the United Kingdom of the definition of radioactive waste adopted by the Government from EC Directive 92/3 (Euratom). Each proposal for the import to or export from the UK of radioactive waste is considered on its merits by the relevant competent authority and no assessment of the overall effectiveness of SI 3031 has been carried out.

The import and export of radioactive waste, including the scope, definitions and requirements of current EU and domestic legislation, are currently being considered in the context of the implementation into UK law of the revised EU Basic Safety Standards Directive (96/29 Euratom). The matters to which my hon. Friend refers will be included in a public consultation document covering some aspects of the implementation of the new Directive, which will be issued later this year.
