To ask the Secretary of State for Health if he will make a statement on the level of charges levied on patients for access to their health records. [26260]

Under the Access to Health Records Act 1990, holders of manual records are permitted to charge an application fee not exceeding £10 to cover the cost of retrieving, collating and examining files. Additionally, the cost of producing a photocopy of the records may be recovered. Computer records are covered by the Data Protection Act 1984. Currently, an application fee not exceeding £10 may be charged for providing copies of computer records.
