To ask the Secretary of State for the Home Department what plans he has to amend the Criminal Appeal Act 1995 to ensure that the Criminal Cases Review Commission can deal with cases where a person is found not guilty by reason of insanity; and if he will make a statement. [63106]

The Government accept that the Criminal Appeal Act 1995 should be amended to enable the Criminal Cases Review Commission to refer to the Court of Appeal a special verdict of 'guilty but insane', under section 2(1) of the Trial of Lunatics Act 1993; and to give the Court of Appeal powers to hear and dispose of an appeal upon such a reference. Such a measure will be brought forward as soon as Parliamentary time allows.
