To ask the Secretary of State for the Environment, Transport and the Regions what mechanisms exist for requiring PowerGen to fit Ferrybridge C power station with flue gas desulphurisation. [39361]

The Environment Agency authorises Ferrybridge Power Station under Part I of the Environmental Protection Act 1990. It is open to the Agency to vary the conditions of PowerGen's authorisation to require such changes as it sees fit for ensuring the use of the best available techniques not entailing excessive cost ("BATNEEC") for the purpose of preventing polluting emissions, or minimising such emissions and rendering them harmless. The Secretary of State also has power to direct the Environment Agency to include conditions in the PowerGen authorisation on this basis.
