To ask the Secretary of State for the Environment, Transport and the Regions what safety procedures are required during railway line maintenance; and what measures are taken to ensure that they are enforced. [35540]

All those involved in the maintenance of the railway throughout Great Britain must comply with their obligations under the Health and Safety at Work, etc. Act 1974, Railways (Safety Case) Regulations 1994 and the Railways (Safety Critical Work) Regulations 1994. Work on Railtrack's network must comply with the requirements of their Rule Book and the Railway Standards (the provisions of which are mandatory on Railtrack PLC and its contractors by virtue of Railtrack's Railway Safety Case and related contractual arrangements).

Inspectors of the Health and Safety Executive's Railway Inspectorate are responsible for enforcing legal requirements relating to health and safety on the railways, including the detailed requirements of the Railways (Safety Case) Regulations 1994.
