To ask the Secretary of State for Health in what circumstances local authorities, in assessing ability to pay for domiciliary services which do not include personal care,(a) should discount attendance allowance benefit and (b) have discretion to exclude from consideration attendance allowance benefit.[16417]

Under the current system local authorities have complete discretion whether or not to charge for non-residential social services.

In assessing ability to pay for non-residential services, authorities may take into account all types of income including social security benefits except the Mobility component of Disability Living Allowance and income from capital.
