To ask the Secretary of State for the Environment, Transport and the Regions if he will take action to ensure that track maintenance undertaken by Railtrack correlates to those areas of track most in need of attention. [65]

The Secretary of State has no powers to force Railtrack to direct its spending to any particular area. Railtrack's annual Network Management Statement gives a guide to the company's own priorities. Responsibility for enforcement of safety duties rests with the Health and Safety Executive who can issue improvement notices requiring works to be carried out by a certain date.
