§ Mr. FaberTo ask the President of the Board of Trade what form notifications should take for the purpose of regulation 33(b) of the Copyright and Related Rights Regulations 1996 (SI, 1996, No. 2967) when authors or performers wish to exercise their right to equitable remuneration for rental of films made under agreements concluded before 1 July 1994. [18864]
§ Mr. Ian TaylorDirective 92/100 EEC, which these regulations implement, does not specify how such notification are to be made and nor, therefore, can the regulations do so. It would nevertheless appear that any form of notifications that clearly indicates an intent to exercise the right to equitable remuneration would be valid for the purposes of regulation 33. Such notifications may be given on behalf of the persons to whom they relate by those representing them, such as professional agents or advisers or organisations such as Equity. It would also appear that notifications need not list individually the performers or films to which they relate to be valid. Ultimately, however, these are matters for the courts to determine.
