To ask the Secretary of State for Education and Employment under what statutory authority orders have been made prohibiting(a) the proposed closure and (b) the sale of Enborne Lodge school in Newbury. [18583]

There are no orders that prohibit either the sale or the closure of Enborne Lodge school. The school was transferred by the Education (Inner London Education Authority) (Property Transfer) Order 1990 to Lambeth local education authority subject to a condition that should the authority cease to use it wholly or mainly for its education functions or should it wish to sell the school it must first offer it to all other inner-London councils for transfer at nil consideration. Statutory proposals to close the school were published on 4 February 1997 and are currently under consideration.

Enborne Lodge is currently subject to conditions in the Education (Inner London Education Authority) (Property Transfer) Order 1990 which specify that proceeds of sale would be divided among the inner-London councils.
