I am aware of concern about employees unable to trace the insurer responsible for employer's liability insurance where a company has gone into liquidation. We are taking forward work on possible options for dealing with this problem as part of our current review of employers' liability legislation. The solution suggested is one of those under consideration. The Law Commission is also considering third party rights against insurers where the insured has become insolvent and will be issuing a consultation document in the autumn.
