To ask the Secretary of State for Scotland what progress he has made in considering the Scottish Law Commission report on incapable adults, Scot Law Corn No. 151. [17534]

On 18 June of last year, I informed my right hon. Friend that I had been giving careful consideration to the Scottish Law Commission's report on incapable adults. I recognised that the report raises a number of issues which are both important and sensitive, and proposes many changes in the law relating to legal procedures for looking after the property, financial affairs and personal welfare of mentally incapable adults.

I therefore announced that, before legislating on the basis of the commission's proposals, there should be further consideration. I have today issued a consultation paper and copies have been placed in the Libraries of both Houses of Parliament.
