To ask the Secretary of State for the Home Department how many exclusion orders under the Licensed Premises (Exclusion of Persons) Act 1980 have been applied for and granted by the magistrate's courts in each year since 1992. [21852]

The imposition of exclusion orders under the Licensed Premises (Exclusion of Persons) Act 1980 is at the discretion of the courts when an offender is convicted of an offence committed in licensed premises and the court is satisfied that in committing that offence he resorted, or offered or threatened to resort, to violence. The imposition of such an order is not dependent upon an application by another person.

Home Office figures show that the following number of exclusion orders was imposed by magistrates' courts in each year since 1992:

  • 1992: 58
  • 1993: 45
  • 1994: 21
  • 1995: 21
  • 1996: 23

On 15 October, we issued a circular reminding the courts of their powers under the Act to impose exclusion orders on offenders.
