To ask the Secretary of State for the Environment, Transport and the Regions what legislation currently governs the use of untreated sewage on agricultural land. [20669]

The Controlled Waste Regulations 1992 (S.I. 1992/588) prescribe as industrial waste sewage disposed of in or on land (other than within a sewage treatment works) and sewage removed from a privy or cesspool. The effect of this is to apply the waste management controls of Part II of the Environmental Protection Act 1990 to the recovery or disposal of these wastes.

The use of sewage sludge (a by-product of the sewage treatment process), including untreated sewage sludges, is controlled under the Sludge (Use in Agriculture) Regulations 1989 (S.I. 1989/1263).
