§ Mr. BurtI have laid before Parliament today a package of minor amendments to regulations concerning the application of the all work test for incapacity benefit which will improve the application of the test, drawing on operational experience since the introduction of the benefit in April 1995. The package will also amend the categories under which people who fail the test are treated as incapable of work in prescribed exceptional circumstances, following a recent decision by the High Court that the wording of the current provisions are unlawful.
