To ask the Secretary of State for Transport what regulatory mechanism is in place in the United Kingdom for checking that aircraft flying into and out of the United Kingdom are insured. [20468]

Mr. Norris

Council Regulation (EEC) No. 2407/92 on licensing of air carriers requires an air carrier with an operating licence granted by the competent licensing authority to be insured to cover liability in case of accidents. The regulation applies to all states of the European economic area and is implemented in the United Kingdom by Statutory Instrument No. 2992 "The Licensing of Air Carriers Regulations 1992". The competent licensing authority in the United Kingdom is the Civil Aviation Authority.

Article 102 of the Air Navigation (No. 2) Order 1995 provides that aircraft registered in a state other than the United Kingdom or another European economic area state shall not operate into the United Kingdom without the permission of the Secretary of State. Permits are not issued to non-European economic area air carriers unless they have provided evidence of insurance.

To ask the Secretary of State for Transport how many cases there have been in the last five years of airlines flying to or from the United Kingdom that are not insured. [20469]
